Terms and Conditions. "The Legal Stuff"
Please read carefully.

1. PinkMonkey.com, Inc, and its affiliates, websites, agents, licensees, employees and licensors (the "Company") provides this Site as a free service. Access to and use of the Site is subject to the terms and conditions of this Membership Agreement, Copyright Notice and all applicable laws and regulations. BY ACCESSING THE SERVICE AND SITES, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS USER AGREEMENT. The Company reserves the right to change these terms and conditions at any time by modifying this screen. By using the Service and the Sites, you agree in advance to accept any changes.

2. The materials used and displayed on the Company's website, including, but not limited to, text, software, photographs, graphics, artwork, video, music and sound, names, logos, trademarks and service marks, are the property of the Company or it's licensors and are protected by copyright, trademark and other laws. Any such content may be displayed solely for your personal, non-commercial use. You agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material,in any form, without specific written permission of the Company.

3. The Sites contain information, facts and opinions from various individuals and organizations. The Information is provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for particular purpose.

4. The Site may include message boards or chat which allow members to post information in or near real-time. You agree not to post or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind. You assume responsibility for, and indemnify and hold harmless the Company and it's agents against any claim arising from any material that is transmitted. The Company monitors or reviews these areas, without obligation to do so. The Company reserves the right, at it's sole discretion, to edit or remove any material posted on the message boards or any member generated content, for any reason and at any time.

5. Your registration and use of the site(s) is voluntary and strictly at your own risk. The Company shall not be liable to anyone for any loss or injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of, or your inability to access or use, the site(s) and content or arising out of any action taken in response to or as a result of any content available on the site(s). You hereby waive any and all claims against the Company arising out of your use of the site(s) and the content available thereon. The company reserves the right to delete any registrations found to contain invalid data or for any other reason without prior warning or consent.

6. Your registration information is confidential and will not be distributed to any other parties without your election to do so. It is used for internal purposes only. Note: If you chose to accept the FreeDrive offer on our registration page, your Email address, Name and PinkMonkey password will be provided to FreeDrive.com to enroll you in their Free Internet Hard Drive offer. This is the only information that will be given to Freedrive if you make this election. All other information is strictly used for the internal functions of PinkMonkey.com and will not be distributed. Any communication or material you post or transmit to the Company or the Site (other than registration information)is non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit, and you grant the Company the right to edit, copy, publish and distribute any information or content you post or transmit (other than registration information) for any purpose without notice or liability.

7. The Company does not regularly monitor any web sites linked to from the Site and is not responsible for the content of any such linked web sites. Your visiting or use of these web sites is entirely at your own risk.

8. If you disclose personal information (e.g., user name, email address, etc.) on a chat, message board or other mechanism, that information can be collected and used by others and may result in unsolicited messages from other parties. You should know that mass-marketing (spam) companies commonly attempt to scan websites for email addresses. The use of your actual email address on a message board could result in unsolicited messages from other parties.

9. By registering and using the site, you represent that you are over the age of 12. The minimum age for registration and use of the site is 13 years. While the content featured on the PinkMonkey site is appropriate for all ages, Federal guidlines under the Children's Online Privacy Protection Act require that we make this condition exist.

10. Your voluntary and elective participation in advertised offers or solicitations presented on the site is entirely at your own risk. You hereby waive any and all claims against the Company arising out of your participation in such offers.

11. The Company will periodically send emails to registered members to alert you to new features, new content, special offers or contests. By agreeing to membership you give your consent to accept periodic emails from the Company. Note: If you choose to participate in offers from other companies advertised or promoted on the site(s), you may provide information to another party and thus become subject to any agreement or terms provided by that party. Any offer you accept shall be subject to the specific conditions of it's controlling party. The Company has no control over your voluntary participation in any offers or promotions and the results thereof.
